TERMS & CONDITIONS

Limitation of Liability
Purchaser shall inspect the goods upon receipt to determine that they are free from any defects or deficiencies. If purchaser is not satisfied with the quality or condition of the goods delivered, DATA-LINC GROUP must be advised immediately. No claims will be accepted for goods which have been subject to misuse, neglect, accident, modification, or claimed defects that cannot be verified by DATA-LINC GROUP. The issuing of credit, repair or replacement of goods deemed by DATA-LINC GROUP to be defective is within its sole discretion. THE LIABILITY OF DATA-LINC GROUP SHALL BE LIMITED TO THE COST OF THE GOODS, REPAIR OR REPLACEMENT, AS DETERMINED BY DATA-LINC GROUP IN ITS SOLE DISCRETION, WHICH SHALL BE THE PURCHASER’S SOLE AND EXCLUSIVE REMEDY. IN NO EVENT SHALL DATA-LINC GROUP BE LIABLE FOR LOST PROFITS, LOST PRODUCTION OR ANY OTHER CONSEQUENTIAL OR INCIDENTAL DAMAGES.

Return Policy
     Return Procedure: Every product returned to DATA-LINC GROUP for service or credit must be accompanied by a Return Material Authorization Number (RMA), obtained from DATA-LINC GROUP ((425) 882-2206) prior to return. Goods without an RMA will not be accepted.

     Refunds: The purchase price will not be refunded if the product has been damaged by the purchaser or by the common carrier chosen by the purchaser to return the goods. The product must be returned complete (including cables and any other hardware, software or manuals sold with the product) within 30 days of receipt in “as-new” and resalable condition (to be determined by DATA-LINC GROUP upon inspection).

     Restocking Charges: Product returned after 30 days and before 90 days of the date of purchase will be subject to a minimum 25% restocking charge and any charges for damaged or missing parts. Products not returned within 90 days of purchase, or products which are not in as-new and resalable condition, are not eligible for credit return and will be returned to the purchaser.

Special Evaluation Period:
Under certain circumstances, a special product evaluation period may be granted to the purchaser by DATA-LINC GROUP. The details and terms of such an evaluation period must be agreed upon in writing by both the purchaser and DATA-LINC GROUP to be valid.

Payment Terms:
Terms of payment are net 30 days from date of invoice unless (a) the purchaser paid for the product in full either at the time the order was placed or at the time the order was shipped, or (b) the terms of payment have been otherwise specified by DATA-LINC GROUP in writing. In the event that payment is not received within the 30 day waiting period, any unpaid balance shall commence to bear interest at the rate of 18% per annum (1 1/2% per month) from the 31st day after delivery.

Freight Charges:
Freight charges, including insurance, are prepaid by DATA-LINC GROUP and added to the invoice.

Shipment:
All domestic shipments are made via UPS Ground Service unless otherwise requested in writing by the purchaser. International shipments are made via UPS (least expensive UPS service available to destination) unless otherwise specified in writing by the purchaser. Partial shipments are made only on specific request.

Warranty (Extended warranty available - please contact DATA-LINC GROUP):
DATA-LINC GROUP warrants its hardware to be free from defects in material and workmanship for a period of one (1) year from the date of delivery, and any action FOR breach of warranty shall be commenced within the same one (1) year period. Extended service contracts are available - please contact DATA-LINC GROUP. This contract shall be interpreted and enforced under the laws of the State of Washington, and venue for any action on this contract shall be in King County, State of Washington. Extended warranty available - please contact DATA-LINC GROUP.
